Harris Legal Search has been exclusively engaged by PACCAR to recruit a privacy attorney to work at its headquarters in downtown Bellevue, Washington.  The Corporate Counsel, Privacy is a newly-created position and will report directly to the Senior Counsel for Compliance.  This hire will provide practical legal and regulatory guidance to the business and other members of the Legal Department on a variety of privacy and security issues.

PRIMARY RESPONSIBILITIES

  • Implement privacy compliance program in the US and non-EU divisions to meet the regulatory requirements of all relevant privacy legislation, such as the California Consumer Protection Act, the Nevada privacy law, privacy regulations in Canada, and any other applicable state, federal, or international privacy laws that might apply to PACCAR operations.
  • Partner closely with PACCAR’s EU operations and EU Data Protection Officer on the implementation of the EU General Data Protection Regulation and the monitoring of international data transfers.
  • Advise the business on the use of personal data and promote the principles of privacy-by-design and privacy-by-default with regard to the development of new initiatives, services, and products that involve the processing of personal data.
  • Provide legal advice and counsel on privacy laws and regulations, internal policies, and industry best practices.
  • Advise the business on the use and processing of personal data on an ongoing basis.
  • Draft and implement policies, procedures, statements, notifications, and organizational controls applicable to data protection, privacy, data retention, and cybersecurity for PACCAR operations in the US, Australia, Brazil, Canada, India, Mexico, and other locations.
  • Develop and perform privacy impact assessments and actively monitor risk findings and mitigation measures.
  • Implement monitoring and risk assessment program for privacy-related policies, procedures, and controls, and assist in privacy audits and investigations.
  • Keep current with relevant industry legislative and case law developments, identifying significant trends and sharing relevant information and knowledge with the Legal Department.
  • Partner with core functional departments, such as Information Security, the IT Department, Marketing, Product Development, and Human Resources.
  • Draft and negotiate privacy and cybersecurity agreements with PACCAR suppliers, partners, and customers.
  • Develop communication and conduct regular privacy training for employees as part of the broader PACCAR Compliance training program.
  • Handle requests and complaints regarding the processing of personal data, both internal and external (data subject rights procedure).
  • Assist with data incident responses and manage data breaches in accordance with the PACCAR’s regulatory requirements.
  • Act as the central contact person for data protection authorities and other external parties related to privacy in the US and non-EU jurisdictions.
  • Provide internal and external data protection compliance reporting to management, including to the PACCAR Security Risk Council.
  • 20% domestic and global travel. 

EXPERIENCE AND PREFERRED QUALIFICATIONS

  • Minimum four years’ experience as lawyer focusing on data protection and privacy law.
  • D. degree and bar membership in good standing (with ability to become licensed member of Washington State bar).
  • CIPP or similar certification a plus.
  • Demonstrated ability to function in large, multi-national organization and provide practical guidance to multiple levels of a company, including executive level management.
  • Affinity with IT/security/technical developments and experience in data security fields.
  • Excellent communication skills.
  • Results oriented and well-developed analytical skills.
  • Proactive approach, with ability to operate independently.
  • Dedication to high integrity, with passion for improving compliance within organizations.
